1. Acceptance of Terms
By downloading, installing, or using Sparky AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Michael Briglio / Imperium Power Systems ("we," "us," or "our"), the operator of Sparky AI.
2. Description of Service
Sparky AI provides:
- An AI-powered assistant for NEC (National Electrical Code) code questions
- 310+ electrical reference modules covering residential, commercial, industrial, and specialty electrical work
- 5 specialized AI modes: code lookup, troubleshooting, calculations, safety guidance, and field reference
- Offline access to reference modules
3. AI Accuracy Disclaimer
Read carefully before relying on AI responses.
Sparky AI uses artificial intelligence to generate responses. While we strive for accuracy and cite NEC article numbers with every answer, AI responses:
- May contain errors, omissions, or outdated information
- Do not account for local code amendments or AHJ interpretations
- Are not a substitute for reading the official NEC publication
- Should not be the sole basis for work that affects safety or requires inspection
Always verify critical requirements with your local Authority Having Jurisdiction (AHJ) and the current edition of the NEC adopted in your jurisdiction. Code editions vary by state and municipality.
4. Professional Responsibility
Sparky AI is designed for use by licensed electricians, electrical contractors, and qualified electrical professionals. By using the App, you represent that you are a qualified professional responsible for your own work.
You are solely responsible for:
- Verifying all code references against applicable NEC editions and local amendments
- Ensuring your work complies with all applicable codes, standards, and regulations
- Obtaining all required permits and inspections
- The quality, safety, and code compliance of any electrical work you perform
5. Subscription & Billing
Free Trial
New users receive a 7-day free trial with full access to all features. No payment is required during the trial period. Your trial begins when you first launch the App.
Free Tier
After your trial ends without subscribing, you retain access to all 310 reference modules and 3 AI questions per day.
Pro Subscription
- Monthly: $9.99/month — unlimited AI questions
- Annual: $79.99/year — unlimited AI questions (save ~33%)
Billing & Cancellation
Subscriptions are managed by Apple (iOS) or Google (Android). Payment is charged to your App Store or Google Play account. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Cancel anytime in your device's subscription settings.
Refunds
Refund requests are handled by Apple or Google per their standard refund policies. We do not directly process refunds. Contact Apple Support or Google Play Support for refund requests.
Price Changes
We reserve the right to change subscription prices. We will notify you in advance of any price changes. Continued use after the price change takes effect constitutes your agreement to pay the new price.
6. Influencer Promo Codes
Partner promo codes provide an extended free trial (typically 30 days) followed by automatic renewal at the standard monthly rate ($9.99/month). By redeeming a promo code, you agree to these billing terms. Cancel before the trial ends to avoid charges.
7. Intellectual Property
All content in Sparky AI — including the 310 reference modules, AI system, app design, and branding — is owned by or licensed to Imperium Power Systems. You may not reproduce, distribute, or create derivative works from our content without written permission.
NEC® and National Electrical Code® are registered trademarks of the National Fire Protection Association (NFPA). Sparky AI is not affiliated with, endorsed by, or sponsored by NFPA. The NEC is the intellectual property of NFPA.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Sparky AI and Imperium Power Systems shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Failed electrical inspections
- Rework or callback costs
- Property damage
- Personal injury
- Loss of business or revenue
- Reliance on AI-generated responses that contain errors
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
9. Acceptable Use
You agree NOT to:
- Use the App to provide professional advice to others without appropriate licensing
- Reverse engineer, decompile, or extract source code from the App
- Attempt to circumvent subscription restrictions
- Use automated tools to scrape or bulk-query the AI assistant
- Resell or sublicense access to the App
- Use the App for any unlawful purpose
We reserve the right to terminate your access for violations of these terms without refund.
10. App Store Terms
If you download Sparky AI from the Apple App Store, these Terms are between you and Imperium Power Systems only — not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Similarly, if you download from Google Play, these Terms are between you and Imperium Power Systems. Google is not a party to this agreement.
11. Termination
We may suspend or terminate your access to Sparky AI at any time for violation of these Terms. You may terminate by cancelling your subscription and deleting the App. Upon termination, your right to use the App ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use after changes take effect constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
